THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6475 OF 2022 ORDER:

This Criminal petition is filed under Section 438 of Cr.P.C., seeking pre-arrest bail to the petitioners/Accused Nos.1 to 5 in the event of their arrest in connection with Crime No.39 of 2022, pending on the file of Chigurumamidi Police Station, Karimnagar District, registered for the offence punishable under Section 306 IPC.

Heard the learned counsel for the petitioners/Accused Nos.1 to 5 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The allegation against these petitioners is that they have harassed the deceased who is the husband of Accused No.1 and threatened with dire consequences. Accused No.1 and the deceased were married 12 years prior to the incident and previously, there were constant fights amongst Accused No.1 and the deceased. The allegation against the petitioners are that A1 and the other petitioners, who are Accused Nos.2 to 5, had abetted A1 in harassing the deceased and also threatened to kill the deceased. Vexed by the constant threats, the husband of the Accused No.1 committed suicide.

In the said circumstances, the petitioners/accused Nos.1 to 5 can be granted the relief of Anticipatory Bail on the following conditions:

1. The petitioners/accused Nos.1 to 5 are directed to surrender before the Station House Officer, Chigurumamidi Police Station, Karimnagar, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/accused Nos.1 to 5 on bail on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to his satisfaction.

2. On such release, the petitioners/accused Nos.1 to 5 shall report before the said Station House officer on every Monday between 10:00 a.m. and 5:00 p.m., for a period of eight weeks and thereafter, as and when required.

3. The petitioners/accused Nos.1 to 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C. and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. 6.

Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
