THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6466 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of Cr.P.C. seeking pre-arrest bail to the petitioner, who is accused No.1 in the event of his arrest in connection with Crime No.428 of 2022 on the file of Uppal Police Station, Rachakonda, registered for the offences punishable under Section 420 of Indian Penal Code and Section 156(3) of Cr.P.C.

Heard the learned Counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. 3.

Since the punishment prescribed for the offences alleged against the petitioner is up to seven years, without going into merits of the matter, respondent-Police are directed to scrupulously follow the procedure as contemplated under Section 41-A Cr.P.C and the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1 scrupulously. It is needless to say, any deviation in this regard will be viewed seriously. However, as the petitioner is aged 70 years, he shall not be arrested during the course of investigation. 4.

The Criminal Petition is accordingly, disposed off. 5.

Miscellaneous applications pending, if any, in this criminal petition, shall stand closed.
