THE HON'BLE SRI JUSTICE MUMMINENI SUDHEER KUMAR WRIT PETITION NO.30205 OF 2022 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 2.

This Writ Petition is filed seeking a Writ of Mandamus to declare the action of the fourth respondent in not conducting enquiry in the matter and for issuance of pattadar pass books pertaining to the land admeasuring Ac.1.04 gts in Survey Nos.440/1, 499, 467 and 471 situated at Wadlakonda Village, Jangaon Mandal, Jangaon District, as illegal and arbitrary. 3.

It is contended by the learned counsel for the petitioner that the father of the petitioner was the absolute owner and possessor of the subject land and his name was also entered into the revenue records and he was also issued old pattadar pass book vide patta No.558 (new No.1218). However, after the demise of the petitioner's father, all the family members have jointly submitted an application before the second respondent requesting for mutation of the subject land in the name of the petitioner herein, who is stated to be a physically handicapped person. The second respondent forwarded the same to the fourth respondent for the purpose of necessary enquiry and

MSK,J W.P.NO.30205 OF 2022 taking steps vide letter in Rc.No.E1/2306/2021 dated 30.11.2021. In spite of the same, the fourth respondent has not taken any action so far and hence, learned counsel for the petitioner prays for passing appropriate orders directing the fourth respondent to conduct necessary enquiry and mutate the name of the petitioner in the online Dharani Portal. 4.

On the other hand, learned Assistant Government Pleader, submitted that after introduction of Dharani Portal, online application is a must in order to consider any mutation or issuance of pass book and in case any such application is submitted by the petitioner, the same would be considered by the respondents in accordance with law.

Taking into consideration the submissions made on either side, this Writ Petition is disposed of permitting the petitioner to submit an online application within a period of two (2) weeks from the date of receipt of a copy of this order and on submission of the same, the respondents 2 to 4 shall consider the same for mutating the name of the petitioner in the place of her deceased father in respect of the land admeasuring Ac.1.04 gts in Survey Nos.440/1, 499, 467 and 471 situated at Wadlakonda Village, Jangaon Mandal, Jangaon District and pass appropriate orders thereon within a period of eight (8)

MSK,J W.P.NO.30205 OF 2022 weeks from the date of submissions of online application by the petitioner.
