Karapakula Bhaskar Naidu, S/O Late Pedaiah Naidu v. The State Of A.P.
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.29822 of 2015 ORDER:
Heard.
Questioning the refusal order, dated 06-04-2015 passed by the 4th respondent, the petitioner has preferred an appeal before the 3rd respondent. In the said appeal, it is stated that the 3rd respondent has already issued notice fixing the date of hearing as 25-06-2015, but, thereafter, the appeal is not taken up and heard and disposed of.
Learned counsel for the petitioner states that there is no prohibition to transfer the land after ten years of assignment made in favour of ExServiceman and as such, there is no impediment in considering the petitioner's documents.
Since the 3rd respondent is seized of the appeal, it is appropriate to direct the 3rd respondent to fix an early date of hearing of the appeal and pass appropriate orders expeditiously, preferably within two months from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 14-09-2015 Prv
