THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 23215 of 2019 ORDER:

In this Writ Petition, petitioner asserts that he is the owner of plot bearing No.50 admeasuring 266.66 sq.yards in Survey No.415 of Rampur, Karimnagar Town; that when he approached the second respondent - Commissioner, Karimnagar Municipal Corporation, Karimnagar, for grant of building permission, the same was not granted; that he approached this Court by way of filing Writ Petition No.13807 of 2018, in which, interim direction was issued to the second respondent herein on 25.04.2018 for considering his application for grant of building permission; that alleging non-implementation of the said order, he filed Contempt Case No.552 of 2019; that thereafter, the second respondent granted permission for construction on 18.06.2019 only to an extent of 131.51 sq.mts out of 189.48 sq.

mts; that when he enquired about the same, the municipal authorities had informed that the said extent stands acquired under the buffer zone and he may claim compensation therefor and that he filed a representation on 30.08.2019 before the second respondent for payment of compensation, but, so far, no action is taken thereon.

CKR, J W.P.No.23215 of 2019 Learned Standing Counsel for Karimnagar Municipal Corporation appearing for the second respondent submits that there is no acquisition of land by the respondent Corporation and that as the said part of the land comes under buffer zone, there is no liability on the part of the respondent Corporation to pay compensation to the petitioner.

In those circumstances, the second respondent is directed to consider the petitioner's representation dated 30.08.2019 and take a decision thereon in accordance with law and communicate the same to the petitioner. This exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.

Subject to the above, this Writ Petition is disposed of. Miscellaneous applications, if any pending, shall also stand disposed of.
