HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20123 OF 2018 O R D E R :

The case of the petitioner is that he submitted application to the 2nd respondent on 05.02.2018 for renewal of his passport bearing No.E3411882, and in pursuance of the same the 2nd respondent issued letter dated 09.02.2018 seeking certain clarification regarding pendency of criminal case against the petitioner in C.C.No.14/2012. Learned counsel for the petitioner submits that petitioner met the 2nd respondent personally and gave clarification with regard to pendency of criminal case. But the same is disputed by Smt.Indrani, learned Standing Counsel for the 2nd respondent stating that petitioner approached the respondents but did not give clarification.

It is to be seen that the application of the petitioner for renewal of his passport is pending before the 2nd respondent. If petitioner satisfies all the conditions they can renew, otherwise the respondents have to pass orders on the application of the petitioner. In case any criminal cases are pending against petitioner the respondents can ask the petitioner to obtain permission from the concerned criminal Court to obtain passport as envisaged in the Notification

issued by the Ministry of External Affairs dated 25.08.1993 in G.S.R.No.570(E). In view of the same, the 2nd respondent is directed to pass appropriate orders on the application of the petitioner, in accordance with Rules, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 21.06.2018 tk.
