THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.505 of 2016 ORDER:

This application is filed to withdraw O.P.No.1440 of 2015 from the file of XVI Additional District Judge, Cyberabad, Malkajgiri, Ranga Reddy District, and transfer the same to Court of Senior Civil Judge, Siddipet, Medak District.

2. Wife filed this application. According to her affidavit, her marriage with respondent was solemnized on 20.08.2014 at Gazwel, Medak District, and both of them lead marital life for two months and thereafter, respondent started harassing her for additional dowry. She stated that in the month of November, 2014, she became pregnant and she was blessed with a male child on 31.07.2015 and respondent and his family members did not take her back nor they came to see the newly born child. She stated that she lodged a complaint under Section 498-A IPC and same is registered as Crime No.282 of 2015. She stated that she also filed O.P.No.151 of 2015 before Senior Civil Judge, Siddipet, Medak District, for restitution of conjugal rights.

She further stated that she is living with her parents with six months old child and it is difficult for her to travel from her place of residence to Malkajgiri, Ranga Reddy District, and there is no male assistance to accompany her. She stated that she is unemployed women solely dependent on her parents and she is not in a position to meet travel expenses. For these reasons, she prayed for transfer of O.P.No.1440 of 2015 from the file of XVI Additional District Judge, Cyberabad, Malkajgiri, Ranga Reddy District, to Court of Senior Civil Judge, Siddipet, Medak District, to be tried along with O.P. pending there.

3. Respondent, in spite of service of notice, neither appeared in person nor through any advocate.

4. Heard arguments of advocate for petitioner.

5. Considering the reasons stated in the affidavit filed in support of this petition and also considering the convenience of wife, O.P.No.1440 of 2015 is withdrawn from the file of XVI Additional District Judge, Cyberabad, Malkajgiri, Ranga Reddy District, and transferred to Court of Senior Civil Judge, Siddipet, Medak District, for disposal in accordance with law.

6. The petition is ordered accordingly. No costs. As a sequel, miscellaneous petitions, if any, pending in this petition, shall stand dismissed.
