HONOURABLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.35790 of 2014 ORDER:

On 22-01-2020, the matter was directed to be listed today under the caption 'for dismissal.' Today when the matter is called, none appears for the petitioner in the fore-noon and after-noon. 2.

The grievance of the petitioner is that the 3rd respondent did not take any action in registering the case on the complaint made by him on 25-10-2014 alleging that the petitioner has been receiving phone calls from certain members threatening him. 3.

Learned Government Pleader for Home appearing for the respondents has placed on record the instructions received from the Sub-Inspector of Police, Shahinayathgunj police station, Hyderabad City, stating that the old records pertaining to the year 2014 were not available in the police station since they were spoiled by termites. However, if any written complaint will be received by them, they would take action in accordance with law. 4.

Considering the fact that the complaint of the petitioner was made in 2014 and as on date, there is no material to show about the efforts made by the petitioner to pursue his complaint and further, on account of the absence of the learned counsel for the petitioner, this Court is of the view that the Writ Petition can be

CKR,J W.P.No.35790 of 2014 disposed of based on the material available on record instead of dismissing the same.

Accordingly, the Writ Petition is disposed of giving liberty to the petitioner to file a fresh complaint, if he has any grievance till today, and on receipt of such complaint, the respondents shall consider the same, forthwith and take necessary steps in accordance with law. No costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
