The case of the petitioner is that he filed appeal before the 3rd respondent along with stay petition against the orders passed by the 4th respondent dated 07.02.2017 in Rc.No11/2017-DT. As no orders are passed by the 3rd respondent in the said appeal, present writ petition is filed. Learned counsel for the petitioner submits that though statutory appeal is pending, the respondent authorities are trying to interfere with the possession of the petitioner. He also submits that the explanation of the petitioner is not at all considered by the 4th respondent before passing the order dated 07.02.2017 and that since the petitioner filed WP.No.5584 of 2017, the respondents passed the order dated 07.02.2017 in hurried manner.

Heard learned Assistant Government Pleader for Revenue.

In view of the aforesaid facts and circumstances, the 3rd respondent is directed to dispose of the appeal filed by the petitioner against the order dated 07.02.2017, within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice and affording opportunity of hearing to

the petitioner. Till the disposal of the appeal, there shall be stay of dispossession.

Accordingly, the writ petition is disposed of. No order as to costs.
