The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of IV1/s T. SATHAIAH Advocate for the Petitioners and of Assistant PUBLIC PROSECUTOR for the Respondent, the Court made the following.

ORDER:

THE HONOURABLE JUSTICE G. SRI DE\/I CRIMINAL PETITION No.7989 of 2021 ORDER:

This Criminal Petition, under Section 438 of the C;ode of Criminal Procedure, 1973, is filed by the petitioners/A2 to A5 seeking to grant anticipatory bail in the event of their arrest in Cr.No.462 of 2021 on the file of Women Police Station, DD, Hyderabad, registered for the offences punishable under Sections 498-4 and 406 IPC and under Sections 3 and 4 of Dowry Prohibition Act.

Heard learned counsel appearing for the petitioners/A2 to A5, learned Assistant Public Prosecutor appearing for the respondenlstate and perused the record.

The case of the prosecution is that A1 , at the instigation of other accused, harassed the de-facto complainant mentally and physically by demanding additional dowry.

Learned counsel for the petitioners submits that th€ petitioners are innocent of the alleged offences and they have been falsely implicated in the present case. He further submits that there are no spr:cific overt acts attributed against the petitioners. He also submits that the petitioners have no criminal antecedents prior to this occurrence and they;rre law abiding citizens and ready to abide by any condition imposed by this Court in the event of their enlargement on anticipatory bail. 5.

Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to petitioners.

Having regard to the facts and circumstances and since there are no specific allegations against the petitioners, without delving into the merits of the matter, I am inclined to grant anticipatory bail to the petitioners/A2 to A5.

The Criminal Petition is allowed and the petitioners/A2 to A5 are granted anticipatory bail subject to the following terms and conditions: (i) The petitioners/ A2 to A5 are directed to surrender before the Station House Officer, Women Police Station, DD, Hyderabad, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond to the tune of Rs.25,0001 (Rupees twenty five thousand only) each with two sureties, out of which one surety shall be from their native place, for the like sum each to his satisfaction.

ii) The petitioners/A2 to A5 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. and cooperate with the investigation.

8, Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
