THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3061 OF 2016 ORDER:

1. This petition is filed by the petitioner-accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.506 of 2015 on the file of the Judicial II Metropolitan Magistrate at L.B. Nagar, Cyberabad.

2. Heard and perused the material available on record.

3. It is alleged that the 2nd respondent has purchased plot No.44 in Sy.No.123 admeasuring 350 sq. feet from its original owner-P.V. Samba Siva Sharma and got registered it in her favour. While so, A1 with the support of A2 and A3 fabricated a document by impersonating the 2nd respondent and registered the above plot in favour of A4 and then, A4 dig a bore well in the said plot. On coming to know about the same, the 2nd respondent lodged the present complaint. Thus, the petitioner and other accused committed the offence punishable under Sections 447, 468 and 471 IPC.

4. Considering the facts and circumstances of the case, this Court is not inclined to grant the relief sought by the petitioner.

5. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court.

6. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically insisted by the trial Court. The petitioner shall be represented by a Counsel before the trial Court on all hearing dates.

7. Accordingly, the Criminal Petition is disposed of. Miscellaneous

petitions pending if any shall stand closed.
