THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6467 OF 2022 ORDER:

This Criminal petition is filed under Section 438 of Cr.P.C., seeking pre-arrest bail to the petitioner/Accused in the event of his arrest in connection with Crime No.95 of 2022, pending on the file of Station House Officer, Rajapet Police Station, Rachakonda Commissionerate, registered for the offences punishable under Section 306 IPC and Section 3(2)(v) of SCs & STs (POA) Act.

Heard the learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the 1st respondentState. Perused the record. 3.

The case against the petitioner/accused is that he had constantly harassed the deceased, husband of the de facto complainant, to return back the amount of Rs.10 lakhs which was previously given to the deceased as loan. Vexed by the petitioner/accused continuously asking for the money, the deceased offered to register land. However, even without listening to the deceased, he was threatening on phone. For the said continuous harassment of the petitioner/accused, the wife, who is the de facto complainant, lodged a complaint saying that unable to bear constant threatening of

petitioner/accused over phone, the husband of the de facto complainant committed suicide.

Notice is served on the de facto complainant and Sri M.V.Hanumantha Rao appeared for the de facto complainant who opposes the bail application on the ground that this petitioner has indulged in series of acts threatening the deceased. The contents of the complaint goes to show that there are money transactions in between the petitioner and the deceased. However, in view that there are transactions over a period of time regarding money, this petitioner/accused can be granted the relief of anticipatory bail on the following conditions: (i) The petitioner/Accused is directed to surrender before the Station House Officer, Rajapet Police Station, Rachakonda Commissionerate, within a period of ten days from the date of this order.

On such surrender, the said Station House Officer shall release the petitioner/Accused on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to his satisfaction. (i) On such release, the petitioner/Accused shall report before the said Station House officer on everyday between 10:00 a.m. and 5:00 p.m., for a period of thirty days and thereafter, as and when required.

(ii) The petitioner/Accused shall abide by other conditions stipulated in Section 438(2) of Cr.P.C. and

shall cooperate with Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. 6.

Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
