"to issue an order or direction, more particularly in the nature of Writ of

Mandamus declare and set aside the impugned Sale Notice dated 14-07-2016 issued by Respondent No.

for auctioning the petitioners mortgaged immovable property on 22-08-2016 is arbitrary, illegal and violation of fundamental rights and consequently direct Respondent No. 2 to withdraw the sale proceedings as mentioned in Sale Notice dated 14-07-2016 under reference No. TELZORDMP16-17-108."

At the hearing, there is no representation for the petitioner.

Learned Counsel representing the respondents submitted that as per her instructions, the dispute between the parties is amicably settled before Lok Adalat on 13-08-2016. As the learned Counsel for the petitioner is not present, this submission of the learned Standing Counsel remained uncontroverted.

In the light of the above, the Writ Petition is dismissed for non-prosecution.

As a sequel to dismissal of the Writ Petition, WPMP.No.34358 of 2016, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________
