THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 242 of 2015 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the appellant upon instructions submits that he does not want to press the appeal. He accepts the judgment and order of the learned
Single Judge. However, he seeks extension of the measure taken by the learned Single Judge enabling the appellant to prefer an appeal for a period of one month from date.
Learned counsel for the respondents submitted that she has no objection. Accordingly, we allow the order passed by the learned Single Judge for not taking any coercive measures to continue for a period of one month from date. This order of extension shall not be construed to have any weightage in the subject matter before the appellate forum or shall be taken to be a fair ground for condonation of delay in the appeal so to be preferred. The writ appeal is accordingly dismissed.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
