This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.03/RCT-ACB-MBNR/2022 on the file of ACB, Mahabubnagar registered for the offence punishable under Section 7(a) of the Prevention of Corruption Act-1988.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioner was arrested on the allegation of demanding and accepting bribe of Rs.7500/- by the ACB. The facts of the case are that the petitioner had demanded and accepted an amount of Rs.7500/- to mutate the lands in the name of de facto complainant. 4.

Learned counsel for the petitioner submits that after the petitioner's arrest he was taken to the hospital and now on suspicion that he might be suffering from Cancer, he was sent to the Osmania Hospital.

In the said circumstances, without going into the merits of the case, on medical grounds this petitioner/Accused can be granted the relief of bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of First Additional Special Judge for SPE & ACB Cases, Nampally, Hyderabad. ii) The petitioner/Accused shall appear before the investigating authorities as and when required immediately after discharging from hospital.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
