THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6473 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.4 in Crime No.331 of 2021 on the file of Station House Officer, Inthezargunj Police Station, Warangal District registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act.

Heard learned counsel for the petitioner/Accused No.4 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The prosecution case is that the quantity of 32 kgs of ganja was seized from the possession of Accused Nos.1 and 2 and this petitioner was also found to be complicit in sale of said ganja and was arrested on the allegation of being part of doing ganja business.

Learned counsel for the petitioner submits that this petitioner is a woman and she has to take care of her infant baby who is 11 months old, as such, the bail can be considered. 5.

Learned Assistant Public Prosecutor submits that the investigation is completed and charge sheet is filed. 6.

In the said circumstances, for the reason of there being no seizures specifically from this petitioner, this petitioner/Accused can be granted the relief of bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.4 is granted bail subject to the following conditions:

i) The petitioner/Accused No.4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of I Additional Judicial First Class Magistrate at Warangal.

ii) The petitioner/Accused No.4 shall appear before the concerned Court on every date of hearing without fail.

iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 28.07.2022 ns
