THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE MS. JUSTI CE J.UMA DEVI LETTERS PATENT APPEAL No.210 of 1998 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) In this Letters Patent Appeal arising out of the judgment and decree dated 24.11.1997 passed by a learned Judge of this Court in A.S.No.200 of 1990, Sri K.B.R.Krishna Murthy, learned counsel, appeared for the appellants. He alone signed the vakalat. We are informed that Sri K.B.R.Krishna Murthy, learned counsel, passed away quite a long time ago. The appellants however did not choose to take any steps to engage another counsel. The appeal was posted for hearing before this Court on 22.11.2017 and taking note of the fact that there was no representation for the appellants, it was directed to be posted for dismissal on 27.11.2017. Today, the appeal appears under the caption 'For Dismissal' but there is no representation for the appellants when the matter is taken up for hearing and despite the names of the appellants being called in the open Court, no one appeared on their behalf.
The appeal is accordingly dismissed for non-prosecution. Interim order dated 18.09.1998 shall stand vacated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
