THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SMT JUSTICE ANIS WRIT PETITION Nos. 26613 and 27592 of 2016 COMMON ORDER: (Per VRS,J) The petitioners in these writ petitions seek the issue of a writ of Mandamus to direct the respondents to treat them as local candidates, as per the Presidential Order, that stood amended by the Government of India Notification in G.S.R.590(E), dated 09.06.2016, which was re-published by the State of Andhra Pradesh under G.O.Ms.No.132, General Administration (SPF & MC) Department, dated 13.06.2016.

2. Heard the learned counsel for the petitioners, learned Government Pleader for the State of Andhra Pradesh, and Mr. Thaddi Nageswara Rao, learned standing counsel for NTR University of Health Sciences.

3. Pursuant to the interim directions issued in a batch of cases of similar nature, the Government of Andhra Pradesh has issued a Circular Memo, dated 08.08.2016, containing certain directions and guidelines. Based upon those directions and guidelines, this Court has already

disposed of a number of writ petitions, where the candidates obtained interim orders from this Court and also secured admission, after participating in the first phase of counselling.

4. But, in so far as the cases on hand are concerned, the petitioners approached this Court, after the first round of counselling was over. Though there was an interim order passed in W.P.No.26613 of 2016 and no interim order was passed in the next case, both the petitioners can participate only in the second phase of counselling now.

5. Therefore, these Writ Petitions are disposed of following the similar orders already passed, directing the respondents to treat the petitioners as local candidates. This is subject to the condition that the petitioners shall comply with paragraph-4(d) of the Circular Memo, dated 08.08.2016, as early as possible. We do hope that the Portal in Mee-Seva for applying for a certificate relating to local status, is operational, to enable the petitioners to approach the concerned Mandal.

Consequently, miscellaneous petitions if any pending in the writ petitions shall stand dismissed. No order as to costs.
