THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42474 OF 2015 ORDER:

Aggrieved by the order of the resumption passed by the Tahsildar, Kamareddy Mandal, in file No.A2/2747/2015-2, dated 02.12.2015, the petitioner states that he has already filed an appeal before 4th respondent on 10.12.2015 together with an application for interim stay. Alleging that neither appeal nor stay petition is taken up, and while stay applications are pending, the order of the Tahsildar is likely to be executed by dispossessing the petitioner, the present petition is filed.

2. Heard Learned Government Pleader for Revenue (TG).

3. Since statutory appeal is pending before 4th respondent, I deem it appropriate to direct 4th respondent to fix an early date for hearing of the appeal and stay petition and pass appropriate orders at least to the extent of the stay petition within a week from the date of receipt of a copy of the order.

4. The Writ Petition is accordingly disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
