This Civil Revision Petition under Article 227 of the Constitution of India is filed by the petitioner questioning the in action of the XIII Additional District, R.R. District, at L.B.Nagar in not disposing I.A.No.928 of 2019 in I.A.No.878 of 2018 in O.S.No.845 of 2018.
2. The petitioner herein is the respondent No.24 in I.A.No.878 of 2018 and defendant No.24 in O.S.No.845 of 2018. The respondent No.1/plaintiff filed O.S.No.845 of 2018 seeking reliefs of partition of 1/3rd share each to the plaintiff, defendant No.1 and defendants 2 to 5, appointment of commissioner to divide the suit schedule property and to declare the documents mentioned in the plaint prayer are as null and void and not binding on the plaintiff and also I.A.No.878 of 2018 seeking interim injunction. At the stage of admission, the trial Court granted adinterim status quo in I.A.No.878 of 2018. Aggrieved by the same, the petitioner filed I.A.No.928 of 2018 to vacate the status quo order as his rights on the property in the manner in which his interest is being affected. But the trial Court kept the said I.ANo.928 of 2018 on one reason or the other without adjudicating the same on merits. Therefore, the petitioner prayed to direct the trial Court to dispose of I.A.No.928 of 2018.
3. Having regard to the facts and circumstances of the case, the Civil Revision Petition is disposed of directing XIII Additional District Judge, R.R. District, at L.B.Nagar to dispose of I.A.No.928 of 2019 in I.A.No.878 of 2018 in O.S.No.845 of 2018 preferably
within a period of two weeks from the date of receipt of a copy of this order. No order as to costs.
