Heard the learned counsel for petitioner, and the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 3, and Smt. Siva Jyothi, Standing Counsel for the Board of Intermediate Education, Andhra Pradesh.

There is no dispute from the petitioner that the factum of filing of charge sheet by the police after investigation in December, 2017 or before and the learned Magistrate taken cognizance in allotting C.C.No.212 of 2018 from the charge sheet dated 19.12.2017. Once such is the case, the Writ Petition duly signed on 11.06.2018 and filed there from in seeking prayer to quash the F.I.R. no way sustainable for the impugnment is the cognizance order and allotment of C.C. number. 3.
Having regard to the above, this Writ Petition is disposed of for no more orders required, but for giving liberty to the petitioner to file a fresh Writ Petition impugning the cognizance order of the learned Magistrate from the police final report, if any. Miscellaneous petitions pending, if any, shall stand closed. ____________________________ Dr. B.
