Petition under section 438 of cr.P.c praying that in the circumstances \ stated in the Memorandum of grounds of criminal Petition, the High court maybe pleased to direct the S.H.O. Nalgonda -ll Town Police Station to enlarge the Petitioners/ Accused Nos.6, 7, 11 and 12 0n bail in the event of their arrest in crime No.263 of 2020, dated 11-1 1-2020 oI Nalgonda -ll Town Police station, Nalgonda District in the interest of justice. This Petition coming on for hearing, upon perusing the Memorandum of Grounds of criminal Petition and upon hearing the arguments of sri Palle Sriharinath, Advocate for the Petitioner and the Public Prosecutor (TG) on behalf of the Respondent No.1 The Court made the following: ORDER

THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 6481 OF 2022 ORDER:

This Criminal Petition is frled under Section 438 of Cr.P.C. seeking pre-arrest bail to the petitioners, who are accused Nos.6, 7, 11 & 12 in the event of their arrest in connection with Crime No.263 of 2022 on the file of Nalgonda II Town Police Station, Nalgonda, registered for the offences punishable under Sections 42O, 406 of Indian Penal Code.

Heard the learned Counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State. 3.

Since the punishment prescribed for the offences alleged against the petitione rs is up to seven years, without going into merits of the matter, respondent - Police are directed to scrupulously follow the procedure a.s contemplated under Section 41-A Cr.P.C and the guidelines formulated by the Hon'bie Supreme Court in Arnesh Kumar v. State of Bihart scrupulously. It is needless to say, any deviation in this regard will be viewed seriously.

The Crlminal Petition is accordingly, disposed off. 5.
