THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.7490 of 2017 ORDER:

This petition is filed, by the petitioner-accused No.1, under Section 482 read with 439 Cr.P.C., seeking to relax the condition imposed in the order dated 16.05.2017 in Crl.M.P.No.502 of 2017 in Crime No.250 of 2016 on the file of the Court of the III Additional Sessions Judge, Bhimavaram.

At the time of hearing, learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the petition with liberty to file a fresh petition before the trial Court.

Permission is accorded.

Accordingly, the Criminal Petition is dismissed as withdrawn with liberty to the petitioner to file a fresh petition before the trial Court by mentioning the specific dates when he will leave India and when he will come to India. If the petitioner files such a petition by giving the above details, the trial Court is hereby directed to consider the request of the petitioner in accordance with law.
