Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. With their consent, the present writ petition is disposed of at the admission stage.

The present writ petition came to be filed with the following prayer:

"to issue a Writ of Mandamus or any other appropriate Writ, Order or direction, declaring the action of the respondents 2 to 4 herein failure to take action pursuant to the Government Memo No.11125/Assn(2)/2015-1, dated 28.5.2015 as illegal and arbitrary and consequently direct the respondents to take action on the petitioner's representations dated 28.9.2015 and 28.11.2015 in terms of Government Memo No.11125/Assn(2)/2015-1, dated 28.5.2015 issued by the 1st respondent."

At the time when the matter is taken up for hearing, learned counsel for the petitioner seeks permission to make a fresh application for conducting survey, in accordance with law. 4.

Learned Government Pleader for Revenue submits that he has no objection for the same.

Having regard to the above, the Writ Petition is disposed of permitting the petitioner to make a fresh application for conducting

CPK,J WP_2318_2016 survey, in which event the same shall be dealt with in accordance with law.
