HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO: 3 9 2 4 OF 2015 O R D E R :

This writ petition is filed to declare the action of the second respondent in not discharging his duties properly to conduct investigation in Crime No. 355 of 2014 of Addanki Police Station, Prakasam district, Andhra Pradesh, as dereliction of duties, arbitrary, illegal and further to direct the respondents to conduct investigation in the above crime, take necessary action and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home [Telangana].

3. Aggrieved by the action of the second respondent in not concluding the investigation in Crime No. 355 of 2014 of Addanki Police Station, the present writ petition is filed.

4. On written instructions, dated 25/8/2015, Sri A. Ramesh Babu, Assistant Government Pleader for Home [Andhra Pradesh] represents before this Court that investigation is completed, witnesses have been examined and charge sheet has been filed. He submits that the allegations made in the writ petition are false on

the premise that when the above crime was under the process of investigation, the present writ petition has been filed.

4. In view of the above submission made by the Assistant Government Pleader for Home, the writ petition is devoid of merits and the same is dismissed. No costs.

5. As a sequel, miscellaneous petitions, if any pending in this writ petition shall stand closed.
