THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.4698 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, to declare the action of the Respondents in not stopping the construction of school building in Silcham lands of Ac 5 03 Gunts in Sy.No. 24 (Bandam Kunta) of Annogiguda Ghatkeswar Mandal Ranga Reddy District and the failure to consider the representation of the Petitioner dated 04.02.2016 in any manner whatsoever as the same is unjust illegal violative of the principals of natural justice public policy apart from being Violative of Section 54 A.P Panchayat Raj Act and the Rules made thereunder and Articles 14, 19 and 21 of the Constitution of India.

Learned counsel for the petitioners and the learned Government Pleader for Revenue (Telangana) stated that, this question is no more res integra and it is clearly squarely covered by the judgment of the Division Bench of this Court in Gram Panchayat Mandapaka rep. by its Sarpanch B. Srinivasa Rao and others v. District Collector, W.G. District, Eluru and others1. In view of the representation made by both the counsel, this writ petition is disposed of in terms of the judgment of the Division Bench of this Court referred supra.

In the result, writ petition is disposed of in terms of the judgment of the Division Bench of this Court in Panchayat Mandapaka rep. by its Sarpanch B. Srinivasa Rao and others v. 1 AIR 1982 AP 15

MSM,J WP.No.4698 of 2016 District Collector, W.G. District, Eluru and others (referred supra).

Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
