THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14990 of 2005 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the proceedings Rc.No.LC/ 876 (14).04.RM.RJY dated 25.10.2004 of the respondent corporation as illegal and set aside the same and consequently to direct the respondent corporation to consider the representation submitted by the petitioner dated 22.12.2004 for appointment in any suitable post under bread winner scheme.

Heard Sri. B.Govinda Rajulu, learned counsel for the petitioner and Sri S.V. Ramana, learned standing counsel for the respondent corporation.

It has been contended by the petitioner that her husband was appointed as driver in Ramachandrapuram Depot and while discharging his duties, he expired on 18.1.1997. The petitioner had submitted a representation to the respondent corporation to consider the case of her son for compassionate appointment under bread winner scheme and the said representation was rejected. Thereafter, the petitioner had submitted another representation dated 22.12.2004 to the respondent corporation and the said representation is not yet disposed of till date. Learned standing counsel appearing for the respondent corporation had contended that since the representation submitted by the petitioner is pending, the respondent corporation

may be directed to pass appropriate orders on the said representation.

This court having considered the submissions made by both the parties is of the considered view that this writ petition can be disposed of directing the respondent corporation to dispose of the representation submitted by the petitioner dated 22.12.2004. Accordingly, the Writ Petition is disposed of directing the respondent Corporation to consider the representation submitted by the petitioner on 22.12.2004 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.
