THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6501 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.424 of 2022 on the file of Station House Officer, Chaitanyapuri Police Station, Rachakonda registered for the offences punishable under Sections 376, 307, 448, 323 and 504 of Indian Penal Code. 2.

Heard learned counsel for the petitioner/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioner was arrested on the allegation of raping the de facto complainant in the name of love. On 19.06.2022 the petitioner went to the house of the de facto complainant and threatened her and beat her with his Kadiyam and also had sexual intercourse and at that time he has also taken videos and photos.

Learned counsel for the petitioner submits that there are no injuries which were found on the de facto complainant and even according to the complaint they are childhood friends and for the reason of some differences between them, the present complaint is lodged. Learned counsel further submits that the parties have already settled the issues and once the petitioner is released on bail, he is going to marry the de facto complainant. 5.

The submission of the learned counsel for the petitioner that no injuries were found on the de facto complainant is not disputed by the learned Assistant Public Prosecutor.

In the said circumstances, since it is a case of differences between two adults who earlier had intimacy with each other, this petitioner/Accused can be granted the relief of bail. 7.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions: i) The petitioner/Accused shall execute a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two

sureties for a like sum each to the satisfaction of VI Additional Metropolitan Magistrate, Ranga Reddy Distirct at L.B.Nagar. ii) The petitioner/Accused shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
