HON'BLE SRI JUSTICE R. KANTHA RAO ASMP No.206 of 2016 & A.S.No.785 of 2008 JUDGMENT:

This appeal is directed against the order and decree dated 10.07.2008 passed in I.A.No.1701 of 2002 in O.S.No.38 of 1993 by the I Additional Senior Civil Judge, Guntur.

Heard the learned counsel appearing for the appellant and learned counsel appearing for the respondents.

Subsequent to filing of this appeal, both the parties entered into compromise and settled the matter outside the Court.

Today, both the parties are present before this Court and stated that they have amicably settled the matter at the intervention of the elders and well-wishers and therefore, they seek to record the terms of compromise entered into between them.

It is submitted by the learned counsel appearing for respondents 1 and 2 that they

have received an amount of Rs.5,00,000/- towards damages instead of Rs.3,00,000/- which was originally agreed before the trial Court. As per the terms of compromise, they agreed to execute a fresh partition deed and get it registered instead of going through the process of Court.

In view of the terms of compromise, which have been appended to the appeal, the final decree passed in O.S.No.38 of 1993 is set aside and the same is decreed in terms thereof. The terms of compromise shall form part of the record.

Accordingly, A.S.M.P.No.206 of 2016 is ordered and the appeal is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
