This Writ Petition is filed with the grievance that respondent No.1 has not been renewing the petitioner's fair price shop authorisation.

By Order, dated 11-08-2009, this Court has directed respondent No.1 to supply essential commodities to the petitioner.

The learned Counsel for both the parties submitted that in pursuance of the aforesaid interim direction, the petitioner is being continued as the fair price shop dealer. The learned Government Pleader for Civil Supplies (TS), however, submitted that no order in writing has yet been passed by respondent No.1 on the petitioner's application for renewal.

In my opinion, when an application for renewal is received by respondent No.1, it is incumbent upon him in law to pass an order either granting or refusing the renewal. As respondent No.1 has not discharged this legal duty, he is directed to consider the petitioner's application for renewal, take a decision thereon and communicate the same to the petitioner within two months from the date of receipt of this order. Till this process is completed, the petitioner shall be continued as the fair price shop dealer.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.19930 of 2009, filed by the petitioner for interim relief, is disposed of as infructuous.
