HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17109 OF 2017 ORDER:

This writ petition is filed by the petitioner challenging the action of the 1st respondent in making attempts to demolish her house bearing Municipal No.5-85/121/B, on plot bearing No.121/B, admeasuring 600 sq. yards in Sy.No.5/3, situated at Raidurg Panmakhta Village, Serilingampally Mandal and Municipality, Ranga Reddy District. 2.

It is the case of the petitioner that she is the owner of the subject property and she also obtained the benefit of Government sponsored L.R.S. scheme and paid an amount of Rs.7,08,930/- on 15.11.2011 and the Government also approved the present subject property. While so, on 13.5.2017, the officials of the 1st respondent-Corporation came to the above premises without any right and without issuing any notice, and threatened that they will demolish the house. 3.

Sri Sampath Prabhakar Reddy, the learned Standing Counsel for GHMC submitted that notices were issued by the respondents and there were some typographical mistakes in the said notices, and fresh notices will be issued.

Considering the facts and circumstances of the case and the submissions made by both the Counsel, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed not to interfere with the subject property, which is in possession and enjoyment of the petitioner, and with the structures therein on the basis of the earlier notices, if any. Further, the respondents are at liberty to issue a fresh notice rectifying the discrepancies in the earlier

notices, if any, and proceed in accordance with law, if they intend to interfere with the subject property or with the structures therein."
