THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.2883 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an order, writ or direction more particularly in the nature of Writ of Mandamus, declaring the action of the respondents 3 and 4 in trying to interfere into peaceful possession and enjoyment of the petitioner property House property bearing No.5-5-35/259/2, on Plot No.55, in Survey No.455 to 458, admeasuring Sq.

yards, situated at Mythrinagar Colony, Kukatpally, Balanagar Mandal, Ranga Reddy District and trying to demolish the structures thereon by without issuing any notice to the petitioner as illegal, arbitrary and violation of Article 19 and 21 of Constitution of India and consequently direct the respondent authorities not to interfere into peaceful possession and enjoyment of the petitioner property at House property bearing No.5-5-35/259/2, on Plot No.55, in Survey No.455 to 458, admeasuring 175 Sq.yards, situated at Mythrinagar Colony, Kukatpally, Balanagar Mandal, Ranga Reddy District till disposal of petitioner application under ULC and Lay Out Regularization pending before the respondent authorities and pass such other order or orders that the Hon'ble Court deems fit and proper in the interest of justice."

The main grievance of the petitioner herein is that the respondent authorities are interfering with the peaceful possession and enjoyment of the aforesaid property of the petitioner and trying

to demolish the structures therein without following the due process of law.

Heard and perused the material available before this Court. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, the respondents are hereby directed not to interfere with the peaceful possession and enjoyment of the aforesaid property of the petitioner without following the due process of law. 5.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
