THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.33115 of 2015 ORDER:
Petitioners complain that the third respondent is not considering the appeal filed by them.
It is evident that the petitioners filed appeal only on 25.05.2015 and even according to them, the third respondent has already called for a report and also records, as is evident from the proceedings, dated 25.08.2015 and 28.05.2015 issued by the third respondent in Rc.E.779/2015, and that a notice to the opposite party was also issued.
Hence, it cannot be said that there is any inordinate delay on the part of the third respondent. As the third respondent has taken appropriate steps to get the records and issued notice, the inaction which is required to maintain this Writ Petition is not made out by the petitioners. However, in the interests of justice, the third respondent is directed to fix an early date, hear the parties and decide the appeal expeditiously.
The Writ Petition is accordingly disposed of. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
