This appeal is filed by the defendant, under section 100 CPC, assailing the judgment and decree dated 23.08.2006 in A.S.No.289 of 2005 on the file of III Additional Chief Judge Court, City Civil Court, Hyderabad, wherein whereby the decree and judgment dated 01.04.2005 in O.S.No.825 of 2003 on the file of II Senior Civil Judge Court, City Civil Court, Hyderabad, decreeing the suit filed by the plaintiff for recovery of possession of suit schedule property and for recovery of arrears of rents, was confirmed. 2.

I.A.No.1 of 2018 is filed to permit the petitioner/appellant to withdraw the second appeal S.A.No.1133 of 2006 in terms of the Agreement dated 05.02.2018 and also confirmation of possession taken and of No Dues or Claims" dated 01.09.2018 entered by the parties.

In view of the agreement entered into between the parties, I.A.No.1 of 2018 is ordered and the second appeal is dismissed as withdrawn. There shall be no order as to costs.
