THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12622 of 2016 ORDER:

The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Honourable Court may be pleased to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring that the inaction of the respondent No.4 in disposing the representation filed by the petitioners 25-03-2016 as highly illegal, improper, unjust, arbitrary, dereliction of duties and violation of Art.14 and 300-A of the Constitution of India and consequently direct the respondent No. 4 to dispose of the representation of the petitioners dated 25-03-2016 and grant police Aid to the petitioners to enjoy their plots in question situated in Sy.No. 49/2 of Kakkalapalli Village, Anantapuram Mandal, Anantapuram District and pass such other order or orders as this Honourable Court may deem fit and proper in the circumstances of the case."

Perusal of the representation dated 25.03.2016 made by the petitioners to the police authorities reflects that their complaint is against a private party, the fifth respondent. There is no indication of any injunction having been obtained by the petitioners from the competent civil court or a direction to the police authorities to aid and assist the petitioners in securing compliance with such injunction. It is not open to the petitioners to avail police assistance for the purpose of settling private disputes.

The representation dated 25.03.2016 therefore warranted no consideration and this Court finds no inaction on the part of the police authorities in this regard. The writ petition is misconceived and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
