THE HON'BLE JUSTICE SRI T. SUNIL CHOWDARY CIVIL REVISION PETITION No.2544 of 2017 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India assailing the order dated 03.04.2017 passed in I.A.No.504 of 2016 in O.P.No.788 of 2014 on the file of the Court of the XVI Additional District & Sessions Judge-cum-XVI Additional Metropolitan Sessions Judge, Ranga Reddy at Malkajgiri. Heard the learned counsel for both the parties. A perusal of the record reveals that the petitioner filed O.P.No.788 of 2014 against the petitioner for custody of their minor son. During the pendency of the O.P. the petitioner filed I.A.No.504 of 2016 under Section 12 of the Guardians & Wards Act for grant of visitation rights. The trial court after affording reasonable opportunity to both parties passed the following order: "In the result, the petition is allowed and the petitioner is permitted to visit the child on every Sunday at the house of the respondent and in the presence of the respondent between 4.00 PM to 7.00 PM pending disposal of the main O.P."

The above order clearly reveals that the petitioner was permitted to spend with his minor son on every Sunday between 4.00 PM and 7.00 PM.

At the time of arguments, the learned counsel for the petitioner submitted that the trial court, without taking into consideration the facts and circumstances of the case, granted only a short time to the petitioner to spend with his son.

Taking into consideration the facts and circumstances of the case, this court is inclined to permit the petitioner to spend with his

son on every Sunday at the house of the respondent and in the presence of the respondent between 2.00 PM and 7.00 PM pending disposal of the main O.P.

With the above observation, the Civil Revision Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions if any pending in this Civil Revision Petition shall stand closed.
