THE HONOURABLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.20684 OF 2018 O R D E R :

This Writ Petition under Article 226 of the Constitution of India, is filed seeking a writ of Mandamus, declaring the inaction of the respondents in stopping the unauthorized constructions of poultry sheds and godowns in Rc.No. 322/3, 323/1 and 324/1 of Undrajavaram Village & Mandal , West Godavari district, as arbitrary, illegal, capricious and consequently to direct the respondents to act upon the complaint, dated 11.05.2018, of the Petitioner.

I have heard the submissions of the learned counsel for the petitioner. Learned counsel for the petitioner, while reiterating the pleadings in the Writ Petition submits that the main grievance of the writ petitioner is inaction on the part of the official respondents in taking action against the construction of poultry sheds and godown by the 7th respondent, without conversion of the nature of the land and obtaining necessary permissions from the authorities concerned. 3.

However, Sri K.K.Durga Prasad - learned Standing Counsel for the 4th respondent - Gram Panchayath would submit that after following the procedure, permission is already accorded for establishment of the poultry farm; and, he also produced for perusal of this court, the copies of such permission, resolution of the Gram Panchayath and the intimation given to the petitioner herein vide letter in reference No. -/2018 dated 15.05.2018. He would further submit that in view of the said events, the writ petition is not maintainable and if the petitioner is aggrieved, he is required to challenge the permission accorded to the 7th respondent.

Accordingly, this Writ Petition is disposed of as infructuous, however, reserving liberty to the petitioner to challenge the above said permission if the petitioner so desires and is so advised. Consequently, miscellaneous petitions pending if any, shall stand dismissed. No order as to costs.
