The petitioner filed this Criminal Petition under Section 482 read with Section 457 Cr.P.C. praying to direct respondent No.2 herein i.e., The Deputy Commissioner of Prohibition and Excise, Warangal Division at Warangal to release tractor and trailer bearing Registration No.AP 36 TB 1345 and AP36 TB 1346 seized under FIR No.93 of 2016, dated 08.07.2016.

Heard and perused the records.

Learned counsel for the petitioner submitted that if the vehicle is kept idle for a long period, there is every possibility of getting it damaged and that the petitioner is ready to produce the vehicle as and when required by the Court below.

It is submitted by the learned Public Prosecutor that the description of the vehicle seized and the deposit is not correct. In view of the facts and circumstances of the case, the criminal petition is disposed of permitting the petitioner to file appropriate application before the 2nd respondent for release of the seized vehicle within one week from today and the 2nd respondent is directed to dispose of the application to be filed by the petitioner expeditiously, in accordance with law Miscellaneous petitions filed, if any, shall stand closed. ________________________ JUSTICE M.S.K.JAISWAL Date : 30.08.2016 Note: issue c.c. by tomorrow b/o kvrm
