THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 16416 of 2011 ORDER:

This Writ Petition was filed with the following prayer: "For the reasons stated in the accompanying affidavit it is prayed that the Hon'ble Court may be pleased to issue order or direction or a Writ more particularly one in the nature of Writ of Mandamus to call for records and remarks from the Respondents herein and connected with Crime No.65 of 2011 of P.S. Nacharam, to (i) beating the deceased daughter of Petitioner by her husbandN.Bhasker, in presence of mother in law-Megha Malla W/o N.Mallaiyah and father in law-N. Mallaiyah on 16-03-2011, (ii)

Complaint to police by Petitioner on 17-03-2011, in the interest of justice or to pass such other order or futher orders as the Hon'ble Court deems fit and proper in the circumstances of the case." Though the aforestated prayer does not indicate as to the nature of the petitioner's grievance, perusal of the affidavit and the counter affidavit filed by the police authorities indicates that the petitioner's daughter died and his complaint was that the police authorities had not taken proper action in the matter. He therefore wanted a fair and impartial investigation to be undertaken. The apprehension voiced by the petitioner is however shown to be baseless in the light of the averments made by the Inspector of Police, Nacharam Police Station, Cyberabad Commissionerate, in his counter affidavit. The said counter manifests that Crime No.

65 of 2011 was registered on the file of the Nacharam Police Station under Section 304-B I.P.C in connection with the death of the petitioner's daughter and after due investigation, charge sheet was laid before the learned XIII Metropolitan Magistrate, L.B. Nagar, Cyberabad, against the husband of the petitioner's daughter and his family members.

In the light of the aforestated developments, the allegation of the petitioner that the police did not properly investigate the crime is demonstrably baseless.

The Writ Petition is accordingly dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
