Heard.

Petitioner is challenging the order of termination from service as Field Assistant. The said order of termination is made based on certain allegations leveled against the petitioner. 3.

A reading of the order impugned would show that after extracting the allegations, it is alleged that petitioner has not submitted valid explanation and therefore termination is made with immediate effect. There is no discussion on the explanation alleged to have been submitted by the petitioner. There is no discussion on the charges leveled and stated to have been proved against the petitioner. In other words, the order of termination from service is not a speaking order and is not sustainable in law. 4.

Having realized that the order cannot be sustained, learned Standing counsel fairly submits that the order may be set aside with liberty to the respondents to take further action in accordance with law.

Having regard to the above, the order impugned is liable to be set aside. Accordingly, the Writ Petition is allowed giving liberty to the respondents to take appropriate course of action by following the due process of law on the allegations leveled against the petitioner. There shall be no order as to costs.

- 3 - Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
