HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20191 of 2018 ORDER: (Oral) (Per Suresh Kumar Kait, J) Vide the present petition, petitioner has challenged order dated 12.06.2018 passed in O.A.No.021/535 of 2018 by the learned Central Administrative Tribunal, Hyderabad Bench, whereby the learned Tribunal issued notice and granted four weeks time for filing reply to the respondents.

Learned counsel appearing on behalf of the petitioner has challenged the aforesaid order of the Tribunal on the ground that the impugned proceedings before the Tribunal were issued without jurisdiction; therefore, the learned Tribunal ought to have granted stay of those proceedings in addition to issuing notice to file reply. Sri P. Bhaskar, learned standing counsel appearing on behalf of the respondents submits that, against the proceedings impugned before the Tribunal, petitioner herein did not file appeal though there was a remedy available to him; however, the revisional authority has passed orders considering the case of the petitioner on sympathetic grounds. In view of the above fact, without going into the merits of the case, we are not inclined to interfere with the order under challenge. Petition is accordingly dismissed. No order as to costs.
