THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.6500 OF 2022 ORDER:

This Criminal petition is filed under Section 438 of Cr.P.C., seeking pre-arrest bail to the petitioner/Accused No.4 in the event of her arrest in connection with Crime No.91 of 2022, pending on the file of Station House Officer, Kodad (R) Police Station, Suryapet District, registered for the offence punishable under Section 304-B IPC.

Heard the learned counsel for the petitioner/Accused No.4 and the learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

The petitioner is arrayed as Accused No.4 in the crime registered for the offence of dowry death. Petitioner is the sister-in-law of the deceased and the deceased was married to A-1 in the year 2017. Due to continuous harassment, the deceased committed suicide. The de facto complainant, who is the mother of the deceased, stated in her complaint that this petitioner, who is the sister in law, had also demanded additional dowry of 75 cents to be given to Accused No.1. Vexed by the said additional demands, the deceased committed suicide on 31.05.2022.

The counsel for the petitioner/Accused No.4 submits that this petitioner belongs to a different village and she has children to look after.

Since there are no specific allegations against this petitioner and the only allegation made against her is demand of additional dowry, this petitioner, who is sister- in- law of Accused No.1 and living in other village separately along with her family, the petition filed by her praying for anticipatory bail can be considered on the following conditions: (i) The petitioner/accused No.4 is directed to surrender before the Station House Officer, Kodad (R) Police Station, Suryapet District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused No.4 on bail on her executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to his satisfaction. (ii) On such release, the petitioner/accused No.4 shall report before the said Station House officer as and when required.

(iii)The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C. and shall cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
