HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.776 of 2017

ORDER

This writ petition is filed challenging the action of the 2nd respondent in allowing the application for condoning the delay of two years ten months in filing appeal by the 5th respondent against the order passed by the 3rd respondent in LTR Case No.115/2013/KTDM, dated 28.2.2014 on the ground that the 2nd respondent has no power to condone the delay under the provisions of A.P.Agency Rules read with Land Transfer Regulation 1 of 1970.

Since the present writ petition is filed against the order allowing the application for condoning the delay, this Court is not inclined to entertain the same. However, the petitioner can raise all the contentions available to her, under law, before the 2nd respondent. The 2nd respondent is directed to consider the contentions, if any, raised by the petitioner before passing orders in the appeal filed by the 5th respondent.

With the above observations, the writ petition is disposed of. No costs.

Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 19th January, 2017 rkk
