THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.20282 of 2018 ORDER:
The grievance of the petitioner was that the Sub-Registrar, Rajendranagar, was refusing to entertain the sale certificate presented by him for registration, in relation to the house bearing plot No.29 at Sai Krishna Colony, Budvel Village, Rajendranagar Mandal, Ranga Reddy District.
It appears that the petitioner was the highest bidder in the sale held by the Bank of Maharashtra in relation to the subject property under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. The complaint of the petitioner was that by letter dated 08.05.2018, the Sub-Registrar stated that a status quo order was pending in a civil suit in relation to the subject property and therefore, the sale certificate could not be entertained for registration.
While so, the learned Assistant Government Pleader for Revenue, State of Telangana, would now inform this Court on the strength of the letter dated 07.02.2019 received from the Sub-Registrar, Rajendranagar, that the suit in O.S.No.4 of 2017 on the file of the learned IX Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar, wherein a status quo order was subsisting earlier, was settled out of Court and it was dismissed thereafter. Pursuant thereto, the sale certificate presented by the petitioner was duly processed in accordance with the Registration Act, 1908 and the Indian Stamp Act, 1899, and was registered as Document No.1341 of 2019 on 06.02.2019. A copy of the registered Sale Certificate is also placed on record.
In the light of this development, the grievance of the petitioner stands settled.
The writ petition is accordingly closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
