HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.12945 OF 2017 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent Authority in not correcting the date of birth of the Petitioner as 2nd July 1980 instead of 22nd January while issuing the Petitioner's renewed passport bearing No.P8823552, as illegal and unconstitutional and consequently, direct the Respondent Authority to issue a fresh passport to the Petitioner by correcting the Petitioner's date of birth as 2nd July 1980 instead of 22nd January 1981 in the Petitioner's Passport bearing No. P8823552 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice." 2.

Heard Sri Zeeshan Adnan Mahmood, learned counsel appearing for the petitioner and Sri Baskula Athik, learned counsel appearing for the respondent.

The main grievance of the petitioner is that a mistake with regard to the date of birth of the petitioner as 2nd July, 1980, instead of 22nd January, 1981, has been crept in his passport bearing No.P8823552 and at the time of renewing the same, the said mistake was brought to the notice of the respondent, but the respondent has not chosen to correct the same while issuing the petitioner's renewed passport.

Without going into the contradictions and the disputed questions of fact, this Court feels that it is just and necessary to dispose of the Writ Petition directing the petitioner to file an application enclosing his Service Record, which is filed before this

TA, J W.P.No.12945 of 2017 Court, indicating his date of birth as 2nd July, 1980. On filing of such application, the Passport Authorities shall consider the same, as per the procedure, and issue a fresh passport to the petitioner. This exercise shall be completed within a period of four (04) weeks from the date of receipt of such application.

With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
