HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.6777 of 2019 O R D E R :

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioner, who is A.1, for grant of anticipatory bail in the event of his arrest in Crime No.499 of 2019 of Chaitanyapuri Police Station, Hyderabad, Rachakonda, Ranga Reddy District, registered for the offences punishable under Sections 420, 406 and 506 of IPC r/w. Section 34 of IPC.

This is a case where the petitioner/A.1 along another accused collected huge amount from the complainant for conducting survey and clearing of the dispute in respect of certain land and did not return the said amount nor get the work done and threatened the complainant with dire consequences.

Heard learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor appearing for the respondent State. Perused the material on record. Learned counsel for the petitioner contends that the petitioner is not guilty of the alleged offences and he is a person of reputation, status and stature in the society and he has not received any amount from the complainant. It is also contended that false allegations are made against the petitioner in order to involve him in the present crime. It is further contended that anticipatory bail application filed by

GSD, J Crl.P.No.6777 of 2019 the petitioner during Dasara Vacation was dismissed by this Court vide order dt.10.10.2019 in Crl.P.No.6152 of 2019. It is also contended that the petitioner is suffering from dehydration and lower respiratory and he was advised complete bed rest. It is contended that the petitioner is ready to abide by any conditions imposed by this Court, including assisting the investigating agency for his release on anticipatory bail in the event of his arrest in the above crime. On the other hand, the learned Additional Public Prosecutor vehemently opposed the relief sought in the above petition.

As seen from the record, it is evident that earlier anticipatory bail application of the petitioner was already dismissed by this Court vide order dt.10.10.2019 in Crl.P.No.6152 of 2019 and this is the second bail application of the petitioner and no new grounds whatsoever have been stated by the petitioner in order to entertain the same. Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
