THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26147 OF 2016 ORDER:
This writ petition is filed challenging the inaction of the respondents in conducting the investigation on the complaint lodged by the petitioner and registered as crime No.32 of 2015 on the file of the Kaligiri Police Station, SPSR Nellore District, under Sections 465, 466, 468, 471, 473 and 120-B IPC.
Though a counter affidavit was filed by the fourth respondent, the then Sub Inspector of Police, this Court was not satisfied and hence, directed the second respondent to file additional affidavit. The second respondent filed additional counter affidavit stating that the record of investigation in crime No.32 of 2015 was reviewed and some lethargy on the part of the Sub Inspector of Police was noticed, for which a Memorandum of Charge was imposed on him on 31.03.2017. The investigation was entrusted to the Inspector of Police vide Memo of even date. It is further stated that the Mandal Revenue Officer, Kaligiri, did not give proper reply to the letter, dated 04.10.2016, which resulted in delay in investigation. In the circumstances, this writ petition is disposed of directing the Inspector of Police, Kaligiri Police Station, to complete the investigation as expeditiously as possible not later than three months from the date of receipt of copy of this order, and file final report/charge sheet before the competent Court.
The writ petition is accordingly disposed of. Miscellaneous petitions, if any pending, shall stand closed.
