THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO APPEAL SUIT No.165 OF 2016 JUDGMENT:

Learned counsel for the appellant filed a memo to the following effect:

"It is submitted that the appellant herein has filed the above Appeal against the orders in I.A.No.729 of 2015 in O.S. No.1214 of 2013, dated 06-01-2016 on the file of XI Additional District Judge (FTC), Ranga Reddy District at L.B. Nagar. AS the appellant herein has vacated the gas agency from premises Pr.No.07-004/63/NR, Plot No.5 to 9, situated at J.K. Nagar, Subhashnagar, Jeedimetla Village, Ranga Reddy District and shifted the same to New Premises on 01-10-2016 in view of the unconditional affidavit given to the Honourable Court in W.A.Sr.No.136126 of 2016 there is no need to peruse the A.S.M.P.No.364/2016 in A.S.No.165 of 2016 and there is no need of payment of rent of Rs.30,000/- per month. The photographs showing the same is herewith filed for the kind perusal of the Honourable Court." 2.

Learned counsel for the respondent received notice of the memo and endorsed to the effect that no objection to dismiss the appeal in terms of the memo.

In view of the above submissions of both sides, this appeal is dismissed in terms of the memo filed by the appellant. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any pending in this appeal, shall stand closed.
