THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 2450 of 2016 ORDER:

This writ petition is filed for the following relief: "To issue a Writ of Certiorari or any other appropriate writ, order or direction calling for the records pertaining to D.V.C.No.15 of 2015 pending on the file of III Metropolitan Magistrate Court at Visakhapatnam now transfer to the II Metropolitan Magistrate Court at Visakhapatnam and quash the same as illegal, arbitrary and be pleased to pass other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice."

Since there is an alternative remedy for seeking transfer of pending criminal case from one Court to another by way of Code of Criminal Procedure, this Court is not inclined to entertain the present writ petition.

The writ petition is dismissed with liberty to the petitioner to avail alternative remedies.

The Registry is directed to return the papers, if any, sought by the petitioner.
