THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION Nos.8115, 8126 & 6415 of 2004 COMMON ORDER:

It is submitted that the issue raised in these writ petitions is squarely covered by the order passed by this Court on 14.11.2018 in W.P.No.26793 of 2003.

In view of the same and for the reasons alike, this Court is of the considered view that in W.P.No.26793 of 2003, the petitioner therein deposited 50% of the amounts determined by the labour Court, but in the instant writ petitions, petitioners have deposited 1/3rd of the amounts as determined by the labour Court. Ends of justice would be met, if the petitioners are directed to deposit 50% of the amounts as determined by the labour Court and the same be permitted to be withdrawn by the respondent workmen, as it was done in W.P.No.26793 of 2003. It is needless to say that the amounts which have been deposited by the petitioners be adjusted against the 50% of the amounts as directed in these writ petitions.

In terms of the above observations, these writ petitions are disposed of. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
